Terms of Service

General Rules

Confit (hereafter referred to as “the Service”) is a service provided by Atlas Co., Ltd., (hereinafter referred to as “Atlas”) to support the holding of academic conferences, exhibitions, and events (hereafter referred to as “events”). To use the Service, all users of the Service are required to consent to this Terms of Service (hereinafter referred to as “TOS”). Users shall agree to the TOS before commencing the use of the Service. In addition to the TOS, individual terms, guidelines, and policies may be added to each service for the use of the Service. Please check before using each service. Individual terms, guidelines, and policies constitute a part of the TOS. The TOS and individual terms, guidelines, and policies constitute the entire service agreement made between Atlas and the users.

Terms of Service (Common)

1: Definitions

  1. The term “user or users” of the Service is the general term for registered users and guest users.
  2. “Registered users” are individual users of the Service who have entered and sent the information required for user registration and obtained approval from Atlas, or exhibitors approved by the society or the exhibition organizer. Registered users can use the Service within the range of each license set by Atlas or the organizer.
  3. “Guest users” are individuals using the Service without registration.
  4. “Intellectual property rights” shall mean the copyrights (including the rights set forth in Articles 27 and 28 of the Copyright Act of Japan), patent rights, utility model rights, trademark rights, design rights, and other intellectual property rights (including the right to acquire such rights or apply for the registration of such rights).
  5. “Submitted data” shall mean any information submitted or otherwise transmitted by registered users using the Service (including, but not limited to, text, images, videos, and other data).
  6. “Organizers” are individuals or corporations that provide operational support for academic conferences, exhibitions, and events in the Service.
  7. “Administrator users” are those granted administrator privileges by Atlas and who use the administrative functions of the Service.

2: Registration

  1. Users who wish to use the Service can ask Atlas for registration by approving the TOS and by providing the specific information that Atlas requires for registration in the way Atlas provides.
  2. Atlas will issue an account for the Service after receiving an application for registration and after accepting the application.

3: Management of IDs and Passwords

  1. Registered users are responsible for keeping and managing their email addresses and passwords. Atlas shall assume no responsibility for any loss or damage caused by the loss, theft, or misuse of email addresses or/and passwords by third parties.
  2. In the event of any change to the registration information, registered users shall promptly notify Atlas of the said changed information in accordance with the method prescribed by Atlas.
  3. Even if registered users suffer a disadvantage due to the failure of the notification set forth in the preceding clause, Atlas assumes no responsibility.
  4. Registered users shall not allow any third party to use their account or lend, assign, change the name of, or sell and buy the account.
  5. Regarding the use of the Service using the email address and password required to use the account, such use shall be deemed to be by registered users regardless of the reason, such as theft, loss, misuse, or unauthorized use by a third party.

4: Withdrawal

If a user wishes to withdraw from the Service, the said user can do so by deleting the account in Account Settings for registered users.

5: Registration Cancellation

Atlas may, without prior notice or demand, delete the submitted data or temporarily suspend the use of the Service by the registered user, cancel the registered user’s registration, or terminate the service agreement in the event of any of the following conditions listed below. Atlas assumes no responsibility for any damage to the registered user caused by the suspension of the Service, cancellation of registration, or the termination of the service agreement under this article.

  1. The registered user failed to comply with any of provisions hereof.
  2. The registered user has not responded to inquiries from Atlas or other communications requiring a response for 30 days or more.
  3. In addition to the foregoing, Atlas has determined that it is inappropriate for the registered user to use the Service, to maintain registration as a registered user, or to have the service agreement remain in effect.

6: Collected Data and Personal Information

  1. The data Atlas acquires from users through the Service shall be handled appropriately in compliance with the Data Policy, stipulated separately.

  2. Atlas shall handle the personal information of users properly in compliance with the Privacy Policy.

  3. Organizers of academic conferences, exhibitions, and events shall at all times comply with the applicable national and other laws and regulations regarding personal information, agree to abide by these TOS at all times, use the personal information of users provided under the following clause, and disclose the respective personal information protection policies to users.
  4. When users register to participate in academic conferences or exhibitions, Atlas shall provide the organizers (including those located outside Japan) of academic conferences or exhibitions with the personal information of users to the extent necessary for participation, and users shall agree to this. The personal information provided by users is managed by the organizers thereof. The organizers shall use the personal information of users for such purposes as holding academic conferences and exhibitions, securing user participation, and providing materials.
  5. In order to provide the Service, Atlas provides the personal information of users to business operators who are entrusted by Atlas and who have signed a nondisclosure agreement.
  6. In addition to the provisions of the preceding three clauses, Atlas does not disclose the personal information of users to third parties without their consent. However, personal information may be disclosed in the following cases:
    • Atlas reasonably judges that it is necessary to disclose personal information in accordance with laws and ordinances.
    • The disclosure of personal information is urgently required for the protection of the life, body, or property of an individual and in which Atlas judges that it is difficult to obtain the consent of the person.
    • The disclosure of personal information is especially necessary for improving public health or promoting the sound growth of children and in which Atlas judges that it is difficult to obtain the consent of the person.
    • The disclosure of personal information is necessary for cooperating with a state agency, a local government, or an individual or a business operator entrusted by either of the former two in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person is likely to impede the execution of the affairs concerned.
    • The service provider changes as a result of merger or otherwise, and Atlas judges that it is necessary to transfer personal information in order to continue the Service.

7: Copyrights and Other Intellectual Property Rights

  1. The intellectual property rights for program content, text, and photographs in the academic conferences and exhibitions provided in the Service belong to the organizer of each of the events. The copyrights to the layouts and the design of the websites belong to Atlas. Only the private use of the information is permitted for users within the scope of the use of the Service. It is prohibited to reproduce, distribute, publicly transmit, or use such information in any other way for purposes other than the use of the Service.
  2. Users hereby represent and warrant to Atlas that they have the lawful rights to submit or otherwise transmit the submitted data, and that the submitted data does not infringe any third party’s rights.
  3. Users shall accept that the organizers of academic conferences, exhibitions, and events have the right to edit the data submitted by users, as well as to decide which data to be accepted for publication.
  4. Users shall agree and acknowledge before submission to comply with the regulations that the organizers of academic conferences, exhibitions, and events provide concerning the attribution of the copyrights and other intellectual property rights and the exercise of the moral rights of author for submitted data.
  5. Atlas assumes no responsibility for problems concerning the regulations and the handling of the copyrights and other intellectual property rights for the submitted data. In the event of a dispute between users and the organizers of academic conferences and exhibitions, other users, or other third parties concerning copyrights and other intellectual property rights for submitted data, the users shall have sole responsibility for resolving the dispute at their expense.
  6. Atlas may change, delete, or otherwise alter the contents (including, but not limited to, text, images, videos, and other data) submitted or otherwise transmitted by using the Service within the scope necessary for the smooth provision of the Service and the construction, improvement, and maintenance of our system.

8: Participation and Submission to Academic Conferences and Exhibitions

  1. By using the Service, users may participate in academic conferences and exhibitions hosted by the organizers thereof. Each academic conference and exhibition are provided by each organizer, and Atlas assumes no responsibility for the holding and management of the academic conference or exhibition and assumes no responsibility whatsoever for any problems or damage caused between the users and the organizers.
  2. By using the Service, users may make submissions in connection with each academic conference, exhibition, and event. In accordance with the purpose of each academic conference, exhibition, and event, users shall make submissions in compliance with these TOS and shall be responsible for their submissions.
  3. If Atlas judges that the data submitted by a user violates these TOS, Atlas may suspend the display of the submitted data or delete materials without obtaining the user’s consent.
  4. Atlas assumes no responsibility for the damage the user may suffer caused by the deletion under the preceding clause.

9: Prohibitions

Upon the use of the Service, Atlas prohibits the acts of users that do or may fall under the prohibitions stated below.

  1. Acts against the TOS or laws and ordinances
  2. Acts against public order and morals
  3. Acts that result in or recommend or encourage criminal acts
  4. Acts that slander or cause disadvantages to the organizers of academic conferences and exhibitions, other users, or third parties
  5. Acts of infringement of copyrights or other intellectual property rights of Atlas, organizers of academic conferences and exhibitions, or third parties
  6. Acts of infringement of property or privacy of Atlas, organizers of academic conferences and exhibitions, or third parties
  7. Acts that give disadvantages to Atlas, organizers of academic conferences and exhibitions, or third parties
  8. Acts that slander, libel, or threaten Atlas, organizers of academic conferences and exhibitions, or third parties
  9. False registration of information upon the use of the Service, including user registration
  10. Misuse of email addresses or passwords
  11. Acts of spoofing
  12. Acts of using the ID or password of another user of the Service
  13. Acts of attacking the Service or deliberately placing a load on the system of the Service
  14. Reverse engineering or other analysis of software or other systems provided by Atlas
  15. Wrongful acts which deliberately affect the operation of the Service
  16. Acts that can produce financial interests
  17. Solicitation activities for organizations or services activities that have nothing to do with the Service
  18. Acts of advertisement, publicity, or solicitation toward third parties without Atlas’s permission
  19. Collection of information about other users of the Service
  20. Other inappropriate acts under socially accepted conventions
  21. Other acts that Atlas deems to be inappropriate

10: Suspension/Stoppage of Service

  1. Atlas may stop or suspend all or any part of the Service without advance notice to registered users in the cases as listed below:
    • In the event Atlas is required to do periodic or emergency inspections or maintenance of computer systems related to the Service
    • In the event computer or communication lines are stopped because of an accident
    • In the event Atlas is unable to continue operating the Service due to an act of God beyond the control of Atlas, such as fire, power failures, or other natural disasters
    • In the event linked services outside of the Service experience a problem, stoppage, or suspension of service, lost linkage to the Service, or a change in specification
    • In the event Atlas has judged that the stoppage or suspension of the Service is needed
  2. Atlas may stop providing the Service at its discretion.
  3. Atlas assumes no responsibility for any damage caused by its actions in accordance with this article.

11: Disclaimer

  1. Atlas, whatever the reason may be, assumes no responsibility for any damage to users or third parties as a result of the delay or suspension of the Service.
  2. Atlas assumes no responsibility for the damage to users or third parties as a result of the registration or refusal or cancellation of registration to the Service.
  3. Atlas assumes no responsibility for the accuracy or fitness for a particular purpose of the information acquired through the Service.
  4. Atlas assumes no responsibility for the damage to users or third parties caused by the information obtained from the Service.
  5. In the event of a dispute between the users and other users, organizers, organizing suppliers, session planners, exhibitors, or other third parties concerning the information provided by the Service and the handling of the submitted data, the users shall have sole responsibility for resolving the dispute at their expense and shall not cause damage to Atlas.
  6. Atlas assumes no responsibility for the harmful activities, such as nuisance activities, by a user of the Service towards another user or a third party.
  7. Atlas assumes no responsibility for any problems that users or third parties may experience with regard to the disclosure of personal information of registered users pursuant to the fourth clause of Article 6 of the TOS.
  8. Atlas may delete data submitted by a registered user, suspend the use of the Service by the user, or delete the registration of the user without advance notice when the transmission of information by the user falls, or Atlas judges it may fall, under any of the items of Article 6. Atlas assumes no responsibility for the damage to users caused by the measures implemented on the basis of this clause.

12: Changes to TOS

  1. Atlas may, at its discretion, change these TOS in the following cases:
    • The change to these TOS is in the general interest of users.
    • The change to these TOS does not violate the purpose of the agreement for the use of the Service and is reasonable in light of the need for the change, the appropriateness of the content after the change, the details of the change, and other circumstances pertaining to the change.
  2. When changing these TOS, Atlas shall notify users of the fact that these TOS will be changed, the provisions of the TOS after the change, and the effective date thereof in a manner deemed appropriate by Atlas at least two weeks prior to the effective date of these TOS after the change.
  3. When Atlas notifies users of the provisions of the TOS after the change and users use the Service after the effective date of the TOS after the change, users shall be deemed to have agreed to the change to these TOS.

13: Restitution

If a user of the Service violates these TOS, the user shall compensate Atlas for the damage caused.

14: Severability

Even if any provision or any part of these TOS is held invalid or unenforceable under the Consumer Contract Act of Japan or other laws and regulations, the remaining provisions of these TOS and the remainder of the provision held invalid or unenforceable in part shall continue in full force and effect.

15: Applicable Law and Jurisdiction

The Service shall be based upon the laws of Japan, and in the event of any dispute between the parties hereto regarding or arising out of the Service, the Tokyo District Court or the Tokyo Summary Court shall have sole jurisdiction in the first instance to the exclusion of all other courts that may otherwise have had jurisdiction.

16: Consultation

Any matter not stipulated in these TOS or any doubts arising with respect to any provision of these TOS shall be promptly resolved upon mutual consultation in good faith between Atlas and the users.

Terms of Service (Administrators)

The organizers of academic conferences and exhibitions shall comply with these TOS when using the Service as administrator users and users, and these TOS and individual terms, guidelines, and policies shall constitute a part of the agreement for the use of the Service. If a separate agreement is made in the form of a contract, application form, or similar document between an organizer and Atlas that takes precedence over these TOS, the provisions of the separate agreement shall prevail.

1: Registration

  1. Administrator users can ask Atlas for registration for the use of the administrative functions of the Service by approving the TOS after entering into a contract with Atlas and by providing the specific information that Atlas requires in the way Atlas provides.
  2. After the application, administrator users will be granted administrator privileges by Atlas and be able to use the administrative functions of the Service.
  3. Administrator users shall ensure that users comply with these TOS and individual rules and shall be obliged to manage such compliance with the care of a good administrator.
  4. When an administrator user uses the Service as a user, they shall also comply with these TOS as applicable to users.

Terms of Service (Users)

1: Registration

  1. Users who wish to use the Service can ask Atlas for registration by approving the TOS and by providing the specific information that Atlas requires for registration in the way Atlas provides.
  2. Atlas will issue an account for the Service after receiving the application for registration.
  3. The Service may become unavailable because of the service outage or a change in specification of third-party systems connected to the Service (e.g., in case user administrative functions of the Service depend partly on third party membership management system). Users are deemed to acknowledge and agree before using the Service that Atlas assumes no responsibility for any damage caused by service unavailability. Also, Atlas does not guarantee anything concerning third party systems.
  4. If an organizer restricts the use of the Service by users, the Service may be used by using the authentication code for the use permission reported by the organizer or with the account registered by the organizer.
